CONCLUSION OF CONTRACT AND DELIVERY OF GOODS
1.1. We conclude contracts exclusively in English. With ordering goods, your contractual partner is Sound of Midgard, Rheinstr.4, 50321 Brühl Germany.
1.2 By clicking the button “buy now” you are placing a binding order for the items in your shopping cart. We will confirm receipt of your order by email after receiving the order. A binding contract is concluded upon receipt of the order confirmation. Please note, that the delivery of the ordered goods with advance payment takes place as soon as the payment of the full purchase price as well as any shipping costs has been received by us.
1.3 You agree to the assignment of the seller’s claims for payment of the purchase price to third parties, in particular to Sound of Midgard
1.4 Please note that, as an exception, we are not obliged to deliver the goods ordered if we have ordered the goods properly on our part, but have not been delivered correctly or on time. The prerequisite is that we are not responsible for the lack of product availability and that we have informed you about this fact. In the event of subsequent unavailability of the good we will reimburse you for payments already made.
1.5 We do not take on the risk of having to procure an ordered product (procurement risk). This applies also when ordering goods that are only described in terms of your type and characteristics (generic goods). We are only reliable for delivery from our stock of goods at hand and the goods we have ordered from our suppliers if delivered according to our order. We deliver worldwide with the respective delivery partner we are not responsible for. If deadlines are specified, we understand this to means Monday to and including Friday, with the exception of statutory holidays.
PRICES AND SHIPPING CHARGES
2.1 The prices listed online apply at the time of the order. The prices shown are final prices, meaning, they include the applicable statutory value added tax (exluding shipping)
2.2. Shipping charges according to “Shipping”.
2.3 For the shipping of particularly bulky, heavy or valuable articles, different shipping charges may apply.
PAYMENT
3.1 In principle, we offer the following payment methods: bank transfer and PayPal. We may keep the right not to offer certain payment methods and to refer to other payment methods. You have to bear any costs of a money transaction.
3.2 In the case of purchase by credit card, your credit card account will be debited when the order is completed.
3.3 In the case of purchase on account, the purchase price becomes payment on the day the customer receives the delivery
3.4 You agree that any order confirmations, invoices, credits and reminders can be sent electronically.
RIGHT OF RETURN / Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. letter sent by post, fax or e-mail). You may use the attached model withdraw form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as result of such reimbursement.

LEGAL LIABILITY AND ADDITIONAL INFORMATION
Any repayment will be sent to a specified account, given to us by you. If you paid by PayPal or credit card, the refund will be made to your PayPal or to your credit card account.
7.1 The statutory warranty for defect articles applies. Sound of Midgard expressly reserves the right to apply to supply the buyer with a defect-free replacement for any defects found and identified in the purchased item.

7.3 You can archive the terms and conditions as well as the data of your order simply on the last page of the order process in the online shop to save the summarized data using the functions of your browser or you can wait for the automatic order confirmation, which we will also send you by email after completing your order to your email address. This order confirmation email again contains the data of your order and our terms and conditions and can be easily printed out or saved with your e-mail program online.
7.4 Should individual provisions of the contract including these regulations be wholly or partially become ineffective or should the contract contain an unforeseen loophole, then this does not affect the effectiveness of the remaining provisions or parts of such provisions. Instead of the ineffective or missing provisions, the respective statutory regulations apply.
APPLICABLE LAW AND JURISDICTION APPLICABLE LAW AND JURISDICTION
8.1 German law applies to all legal transactions or other legal relationships with us. The UN sales law (CISG) and any other international agreements do not apply. With contracts for a purpose that is not attributed to the professional or commercial activity of the beneficiary (contract with consumers), this choice of law only applies as the protection is granted by mandatory provisions of the law of the state in which the consumer has his habitual residence, otherwise it is withdrawn.
8.2 With regard to consumers, the place of jurisdiction is the Sound of Midgard domicile. in the dealings with merchants, the place of jurisdiction for all legal disputes about the terms and conditions and individual contracts concluded under their validity, including bills of exchange and check lawsuits, the place of jurisdiction can be the merchants.
